The Graveyard

The following list is made up of old time 1920's songs which were recently forced to be removed from Melody Lane because they were either:

1) prevented from going into the public domain,

or

2) placed back into copyright protection after transferring into the public domain,

because of the unrighteous Sonny Bono Copyright Extension Act (1998),
passed by both the Senate and the House and signed by then-President Bill Clinton.

After receiving a legal threat from the Harry Fox Agency, the music licensing organization, instigated by the Rodgers and Hammerstein Organization (Williamson Music) in early March 2001, I felt I had no choice but to remove the following songs on Melody Lane, after re-educating myself on the new copyright laws, since I had been going on older information that I had read online and in older books on copyright law.

If you would like more information about why and how this travesty of stealing from the public domain was allowed to happen, please visit Arizona State Professor of Law's Dennis S. Karjala's excellent website OPPOSING COPYRIGHT EXTENSION. This site has names and addresses of your Senators and Congresspeople, so you can email or write to them and express your outrage that your musical heritage has been stolen from you. 95 years is WAY TOO LONG for a work to be copyright protected, it is way over an average generational life span of 75 years, and is unprecedented in American history.

I want my visitors who love music to understand what happened and how to educate themselves on the importance of safekeeping the public domain.

Don't let the politicians in Washington extend it to 120 years or 150 years next time (and they will try to do it),  or we could possibly see the day when even Stephen Foster's songs could go back into copyright protection! Washington D.C. is supposed to protect the public's interests, not special interests.

Write to your representatives in Washington D.C. and tell them to
stop taking soft money from private interests to keep extending copyright durations,

Update: the U.S. Supreme Court has agreed to revisit the unrighteous Sonny Bono Copyright Extension Law,
and might overturn it. The public might actually be given some rights back if that happens, and these songs might be able to be
reinstated on Melody Lane, so keep it in your prayers. A ruling might come by October of 2002.
